MWM Privacy Policy

This MWM Privacy Policy applies to websites, mobile applications, games, and other interactive features and online services owned or operated by Madison Wells Media, LLC or one of its subsidiaries or affiliated companies or businesses (collectively, “MWM”) that post a link to or include this Privacy Policy (collectively, the “Services”).  By accessing, using or otherwise interacting with any part of the Services, or by otherwise providing information to MWM, you agree to the collection, disclosure, and use of your information as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, do not access or use the Services or provide personal information to us.

SUMMARY

The following is a short summary of the key elements of this Privacy Policy, but please review our full privacy policy, below, before using the site.

We may collect personal information from or about you, including personal contact information, demographic information, payment information, and user content you submit to us. 

We primarily use this information in connection with your relationship with MWM, your use of the Services, processing your transactions, improving our Services, for sending you information from us, and tailoring the information we provide to you. We also automatically collect information through your use of the Services, which may include information about your location inferred from your IP address, as well as usage information about your device, such as  browser and operating system, how you arrived at our Services, device identifiers, and information received through our use of cookies and other technologies. We may also collect information about you from third parties. Please review the “INFORMATION WE MAY COLLECT THROUGH THE SERVICES” and “HOW WE MAY USE THE INFORMATION COLLECTED” sections of this Privacy Policy for a full description of the information we collect and how we use that information.

We may share your information with third parties, for example, third party service providers, in relation to sweepstakes, contests, and promotions, and for administrative and legal reasons. For full details, please review the section below titled “HOW WE MAY USE THE INFORMATION COLLECTED”.

We also offer you choices on what we do with your information, and offer those who have an online account  the opportunity to view, update, or edit account registration data. We employ commercially reasonable administrative, technical and physical safeguards; however, no system can be guaranteed 100% secure. We therefore cannot ensure or warrant the security of any information that you transmit to us, or that we transmit to you

INFORMATION WE MAY COLLECT THROUGH THE SERVICES

We collect information from you directly, automatically when you visit the Services, and sometimes from third parties. Some of this information may be considered “personal information” under various applicable laws. We consider information that identifies you as a specific, identified individual to be personal information (such as contact information), and we treat additional information, including IP addresses and cookie identifiers, as “personal information” where required by applicable law. And, if we combine information we consider to be non-personal with personal information, we will treat that combined information as personal information under this Privacy Policy and as required by law. Note that we may de-identify personal information so that it is non-personal, such as aggregating or converting it to a code, sometimes using a function commonly known as a “hash”. We will treat de-identified information as non-personal to the fullest extent allowed by applicable law.

Information You Provide to Us Directly 

MWM may ask you to provide information directly when you interact with us, such as contact information, including your name, phone number, mailing address, and email address, other information about you, such as demographic information (ZIP code, gender, and day and month of birth, for example) and information about your interests and preferences. You may provide personal information, demographic data and other information through various forms and features on the Services or when you otherwise interact with us. We will also collect personal information and payment information when you make a purchase through us. 

Our Services are intended for a general audience and not intended for use by or targeted to those younger than the age of 16. We do not knowingly collect personal information from children younger than the age of 16. 

Information We Collect Automatically As You Access the Services 

We, and our third-party business partners (including any third-party service providers or third party advertising, content, or analytics providers), may use a variety of technologies that automatically or passively collect certain information about your use of the Services whenever you visit or interact with the Services (“Usage Information”). This Usage Information may include the website browser or operating system you are using, the URL that referred you to our Services, the search terms you entered into a search engine that led you to our Services, all of the areas within our Services that you visit, and the time of day, the next website you visit after leaving our Services, among other information. We may use this Usage Information for a variety of purposes, including analyzing trends, administering the Services, tracking users' movements around the Services, gathering demographic information about our user base as a whole, and enhancing or otherwise improving the Services. As you use the Services, we may also track videos you watch and audio you listen to and how you interact with the content. You acknowledge that, if you choose to post any information about your video watching or viewing history on a third-party platform or in the MWM Community (described below), the Video Privacy Protection Act of 1998 (18 U.S.C. § 2710) (or any similar state law) does not apply. However, to the extent it does apply in any manner, you are providing your informed, written consent to the disclosure of that information pursuant to the Video Privacy Protection Act. 

In addition, we automatically collect your IP address or other unique identifier (“Device Identifier”) for your computer, mobile phone, or other device used to access the Services. A Device Identifier is a number that is automatically assigned to your device used to access the Services, and our servers identify your device by its Device Identifier. We may be able to collect or infer your approximate location based on your Device Identifier or similar information we collect. 

We use the following types of tracking technologies to automatically collect information when you interact with us online: 

Cookies and Local Storage. “Cookies” and local storage are pieces of information (data files) transferred to an individual’s browser on their device when the device is used to visit a Site. These technologies are able to store a unique identifier for a device to allow a certain Internet site to recognize the device whenever the device is used to visit the Services. These technologies may be used for many purposes by us and our third-party service providers, such as automatically collecting Usage Information, enabling features, and remembering your preferences. We may use cookies and other technologies to study traffic patterns on our Services, to make them even more rewarding as well as to study the effectiveness of our customer communications. And we may use cookies to customize your experience and provide greater convenience each time you interact with us. The information we store includes internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. If you choose to disable cookies or restrict local storage, some features of the Services may not function properly. 

Pixel tags. Pixel tags are tiny graphic images or other web programming code that tell us what parts of our website customers have visited or to measure the effectiveness of searches customers perform on our Services. Pixel tags and similar technologies may be used for a number of purposes, including, without limitation, to count visitors to a Site, to monitor how users navigate the Services, to count how many emails that were sent were actually opened, to count how many particular links were actually viewed. Pixel tags also enable us to send e-mail messages in a format customers can read. 

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider, is active only while you are connected to a Site, and is deactivated or deleted thereafter.

Click Through URLs. In some of our e-mail messages we use a "click-through URL" linked to content on the Services. When a customer clicks one of these URLs, they pass through our web server before arriving at the destination web page. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. 

In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.

Community Forums and User Submission 

The Services may provide you the opportunity to register and participate in posting content publicly in forums, through interactive features and through other communication functionality (“MWM Community”). Those forums may ask you to create an account, may allow you to submit or post photographs, videos, questions, comments, suggestions, or other content (collectively “User Content”), and may have separate terms that govern your submission of data and use of the MWM Community. If you create a profile, certain information will be made available to other users or the public, as disclosed on the MWM Community page or within MWM Community terms. For example, you may be able to organize certain submissions (such as images you upload) into public or private albums.  Please see our Terms of Use, for more information about the MWM Community, User Content and our Community Usage Rules.

Note that anything you post to the MWM Community is public—others will have access to your User Content and may use it or share it with third parties. 

If you submit User Content through the MWM Community, “Contact Us” feature or other means the User Content may be used by MWM for its business purposes and may be published online or offline (including, without limitation, on the Services or any other format currently existing or later developed). In addition, we may use your User Content and any excerpt from your User Content in connection with our advertising, marketing, publicity, and promotional activities. 

Social Media Interactions 

The Services may permit or facilitate interactions with an interactive third-party website or service (“Social Media”), such as enabling you to “like” or “share” content. If you choose to share content or otherwise post information from or via the Services to Social Media, that information may be public and the third party may have access to information about you and your use of our Services. You may also choose to participate on Social Media in a way that connects that third-party service with our Services (such as posting to one of our pages on a Social Media site or signing into the Site with your credentials from another website or service). Doing so may allow us to collect (or the third party to share) information about you, including personal information. 

Also, both we and the third party may have access to certain information about you and your use of the Services and the third-party service. These Social Media sites may collect information about your visit to our Services through the features we have integrated into the Services and may be able to collect certain information about your visits to the Services regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the social networking company. 

We may also receive information about you if other users of Social Media give us access to their profiles and you are one of their connections or “friends”. The information we collect is subject to this Privacy Policy. The information collected and stored by the third party remains subject to the third party’s privacy practices, including whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but may retain the information previously collected. 

Send to a Friend Features and Information You Provide about Others  

If you send a friend a communication from the Services, the information you provide (names, email addresses, etc.) is used on a one-time basis to facilitate the communication and is not used for any other marketing purpose, unless we obtain consent from that person. If you otherwise disclose any personal information relating to other people to us, you represent that you have the authority to do so and permit us to use the information in accordance with this Privacy Policy.

Information Third Parties Provide To Us About You 

We may receive information about you from third parties. For example, if you are on another website and agree to receive information from MWM, that website will forward your information to us so that we may contact you. We may also supplement the information we collect with outside records from third parties, public databases, or publicly available Social Media pages, for various purposes, such as to provide you with information, services or products, to tailor our content and the offers we show you, or to enhance our products and services. 

We may combine the information we receive from third parties with information we collect through the Services. In those cases, we will apply this Privacy Policy to the combined information.

HOW WE MAY USE THE INFORMATION COLLECTED 

MWM may use information collected through the Services (including your personal information and Usage Information) in order to: (1) allow you to participate in the Services and providing you with services, announcements, information, and any features or activities we offer through the Services, including marketing and offers from us and on behalf of third-parties; (2) personalize your experience and tailor content we display to you, such as advertising, recommendations, promotions, and offers we display to you; (3) process information you provide via your account registration with the Services, including, verifying that your email address is active and valid; (4) fulfill transactions and process payments and orders; (5) provide customer service, including in connection with any delivery, billing, or payment processing inquiries; (6) facilitate your job search via the Services and prepare related governmental and internal statistics reports; (7) communicate with you regarding your use of the Services (such as about a transaction, to notify you if you have won a contest or promotion, or to respond to you when you contact us) or other administrative communications, including, in our discretion, changes to the Services’ Privacy Policy, or any of our other terms or policies; (8) protect our Services and our customers from errors, misuse of the Services, fraud, or any criminal activity and detect and troubleshoot problems, resolve disputes, and enforce applicable agreements and policies for the Services; (9) further internal business purposes, such as to improve our Services or our products and services, and to comply with regulatory and legal obligations; or (10) as otherwise disclosed in this Privacy Policy, as disclosed at the time you provide your information or otherwise with your consent.

WHEN WE DISCLOSE YOUR INFORMATION TO THIRD PARTIES 

MWM may share non-personal information, such as Usage Information, de-identified or aggregated user statistics with third parties in our discretion. We do not share your personal information with third parties for those third parties' marketing purposes unless we provide you the opportunity to opt-in or opt-out prior to such sharing. In addition, MWM may share information we have collected about you, including, without limitation, personal information and Usage Information, as disclosed at the time you provide your information or otherwise with your consent, as described in this Privacy Policy and in the following circumstances:

MWM Family of Companies. MWM includes several brands and companies, some of which operate as subsidiaries, affiliates or joint ventures.  When MWM collects information on one of our Services, it will be accessible by other MWM family of brands and companies that post this Privacy Policy.  The information will be used for business, operational and marketing purposes.

Third Parties Providing Services on Our Behalf. We may share information with third parties who perform services on our behalf, such as website hosting, processing information, sending email or other communications, fulfilling customer orders and processing payments (including clearing and processing credit card payments), running promotions, providing marketing assistance and data analysis (including assessing your interest in our products and services or conducting customer research/satisfaction surveys), and performing other services. We may provide access to your personal information to such third parties in order for them to perform these services. Without such information being made available to these third parties, it might be difficult for you to purchase services, receive customer service, provide us feedback to improve our services, or access certain services, offers, and content on the MWM Services.

Administrative and Legal Reasons. MWM may transfer and disclose information, including your personal information, Usage Information, and Device Identifier (e.g. IP address) with third parties to comply with a legal obligation, when we believe in good faith that the law requires it; at the request of government or investigatory authorities conducting an investigation; to verify or enforce our applicable Services terms and policies; or otherwise to protect our rights, property, safety, or security or that of other Services visitors or the public, such as when we are investigating potential fraud. For example, we may share information to respond to a court order or subpoena. We may also use Device Identifiers to identify users, and may do so in cooperation with copyright owners, Internet service providers, wireless service providers, or law enforcement agencies, in our discretion.

Sweepstakes, Contests, Promotions. We may offer sweepstakes, contests, or other promotions (any, a “Promotion”), that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may require specific requirements of you (including, without limitation, and except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, as required by law or permitted by the Promotion’s terms or official rules (such as on a winners list). 

Employment Applications. If you apply for a job with MWM or any of our subsidiaries or affiliated companies, we or our service provider(s) may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission and other federal, state and local regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide such information, we and/or our service provide may submit that information to the appropriate government or regulatory agencies to fulfill reporting requirements and use that information to defend against employment-related complaints.

Please note that we may utilize a careers portal that is operated by a third party, in which case your use of the careers portal will be subject to the third party’s privacy practices as disclosed on the portal, and not to this policy. 

Business Transfers. In the event MWM goes through a transition such as being sold, has all or a portion of its assets acquired or transferred, whether voluntary or involuntary (such as through bankruptcy), or merges or becomes affiliated with any other division, individual or entity (including, without limitation, during the course of any due diligence process), any customer information owned or under the control of MWM (including, without limitation, your personal information) will likely be one of the transferred assets. We reserve the right, as part of this type of transaction, to assign or otherwise transfer your information (including, without limitation, your personal information) and other information we have collected from users of the Services. By providing your personal information, you agree that we may transfer such information to the acquiring entity without your further consent. For example, if part of our business was sold we may give our customer list as part of that transaction. 

THIRD PARTY LINKS AND CONTENT

The Services may link to or incorporate websites or content hosted and served by third parties over which we have no control and which are governed by the privacy policies and business practices of those third parties. MWM is not responsible for the privacy practices or business practices of any third party.

THIRD PARTY ANALYTICS PROVIDERS, AD SERVERS, AND SIMILAR THIRD PARTIES

The Services may contain content served by third parties, including videos and audio, and we work with third party business partners (including Facebook) to help us understand how people navigate and use our Services. In connection with serving content and providing analytics and advertising services, third parties may collect certain information about your visits to this or other websites, and we may receive information regarding the use of the Services and the effectiveness of our advertisements. These third parties may set and access their own tracking technologies on your device (including cookies and pixel tags) and may otherwise collect or have access to information about your visits to and activity on the Services as well as other websites or online services. Some of these parties may collect personal information from you over time when you visit the Services or other websites and services. 


Cookies and pixel tags used by us and on the Services, including those set by third party network advertisers, including Facebook, may be used to, among other things, target advertisements, prevent you from seeing the same advertisements too many times and to conduct research regarding the usefulness of certain advertisements to you. We may share Usage Information about visitors with third party advertising companies, analytics providers and other third parties for similar purposes. While we may use a variety of service providers to perform advertising and analytics services, some of these companies are members of the Network Advertising Initiative ("NAI”) or the Digital Advertising Alliance ("DAA") Self-Regulatory Program for Online Behavioral Advertising. You may want to visit networkadvertising.org/managing/opt_out, which provides information regarding targeted advertising and the "opt-out" procedures of NAI members. You may also want to visit or aboutads.info/choices, which provides information regarding targeted advertising and offers an “opt-out” by participating companies in the DAA Self-Regulatory Program.

For mobile apps, you may be able to limit certain advertising practices using the settings on your phone, tablet or other mobile device. Also, on most mobile devices, you can install the DAA's AppChoices app to make choices about cross-app interest-based advertisements from participating third parties. Please note opting out through these mechanisms does not opt you out of being served advertising. You will continue to receive generic ads while online.

HOW WE RESPOND TO “DO NOT TRACK” SIGNALS 

Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, our Services do not alter their practices when they receive a “Do Not Track” signal from a visitor’s browser except as specifically required by law. DATA SECURITY

MWM uses commercially reasonable security methods -- including administrative, technical, and physical measures -- to safeguard your personal information against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction. 

However, no system can be guaranteed 100% secure. We therefore cannot ensure or warrant the security of any information that you transmit to us, or that we transmit to you, or guarantee that it will be free from unauthorized access by third parties. You use the Services and provide us with information at your own initiative and risk.

CONSENT TO TRANSFER AND STORAGE IN THE UNITED STATES

MWM is a United States company. Please be aware that information we collect will be transferred to and processed in the United States and other countries. By using the Services, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing, and storage of your information in the United States and other jurisdictions, the privacy laws of which may not be as comprehensive as those in the country where you reside and/or are a citizen. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to laws in those jurisdictions.

ACCESSING AND UPDATING YOUR INFORMATION AND YOUR CHOICES

You can unsubscribe from marketing emails through the opt-out mechanism included in each marketing email we send to you. Note that we reserve the right to send you certain email or postal communications relating to your use of our Services, service announcements, notices of changes to this Privacy Policy or our other terms, or similar administrative or transactional messages, and these transactional account messages may be unaffected if you choose to opt-out from marketing communications. 

You may have the opportunity to utilize features on the Services that permit you to register for a user account. If you have an online account, you are responsible for maintaining and updating, as applicable, your account registration data with current, accurate, and complete information. You may have the ability to view, update, and/or edit the registration data you have provided to us by logging in to your account and following the appropriate instructions or by contacting us with your request at legal@madisonwellsmedia.com. If we offer and you utilize such a feature, we will make requested changes in our active databases as soon as reasonably practicable. Note, however, that we may retain information that you have updated or changed for internal or administrative purposes.

CHANGES TO PRIVACY POLICY

To the extent allowed by applicable law, MWM reserves the right to change or modify this Privacy Policy in our discretion at any time and will notify you of material changes by posting the changed or modified Privacy Policy on our Services. We may also provide notice to you in other ways in other discretion, such as through contact information you have provided. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified, and your continued use of the Services after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will constitute your consent to those changes to the fullest extent allowed by applicable law. We will not use your personal information in a manner materially different than promised at the time the information was collected without giving you the chance to consent (which may be opt-out consent or which may occur through your continued use of the Services) to the new policy, as required.

This notice supplements Madison Wells Media, LLC’s (“MWM”) Privacy Policy and applies only to California consumers.  This California Privacy Notice sets forth the disclosures and rights for California consumers regarding their Personal Information, as required by the California Consumer Privacy Act (“CCPA”).  Terms (including defined capitalized terms) used in this California Privacy Notice have the same meanings given in the CCPA and the regulations of the Attorney General implementing the CCPA, unless otherwise defined.

EXERCISING YOUR CALIFORNIA ACCESS AND DELETION RIGHTS 

California residents have the right to request: (1) that we disclose to you what Personal Information we collect, use, disclose, and sell, including the right to request that we provide to you the specific pieces of Personal Information we have collected about you in the prior 12 months (“Right to Know”); and (2) that we delete the Personal Information we collect about you (“Right to Delete”), all subject to exceptions set forth in the CCPA.  More information on these rights is below. 

Agents

If you are an agent submitting a request on a user’s behalf, please send an email to legal@madisonwellsmedia.com with a declaration signed by the individual who is the subject of the request authorizing you to make the request on their behalf.  The written permission must state your full legal name, the full legal name of the individual who is the subject of the request, and needs to be clear about the permission granted.  Alternatively, you may submit a copy of a power of attorney under Probate Code sections 4000-4465. In either case, please also indicate in your email the nature of your request. The consumer’s identity, in addition to your own, will need to be independently verified in order for us to be able to fulfill your request.  We may also ask the consumer to directly confirm with us that they provided you permission to submit a request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer’s behalf, we may deny the request.

How to Make Request to Know or Request to Delete

Verifying Requests

Please provide your first and last name, email address you have used to interact with MWM, mailing address, and telephone number, which we will use to verify your request. We may ask for additional information as needed to fully verify you or your request.

If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf), we will not be able to process the request.

In order to have us provide specific pieces of information, we will require a signed declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.  

Request to Delete

To ensure that we do not delete your personal information in response to a fraudulent request, once you submit the request, we will follow up to confirm that you want your information to be deleted. 

THE SALE OF PERSONAL INFORMATION MWM does not believe that it engages in sales of personal information as defined by the CCPA. Accordingly, MWM does not knowingly sell Personal Information of minors younger than 16 years of age.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

California consumers have the right to not receive discriminatory treatment for exercising CCPA rights.  We will not discriminate against you for exercising your CCPA rights.

Pursuant to California Civil Code Section 1798.83, residents of the State of California have the right to request from companies conducting business in California certain information relating to third parties to which the company has disclosed certain categories of personal information during the preceding year for the third parties' direct marketing purposes. Alternatively, the law provides that a company may comply, as MWM does, by disclosing in its privacy policy that it provides consumers choice (opt-out or opt-in) regarding sharing personal information with third parties for those third parties’ direct marketing purposes, and information on how to exercise that choice.  As stated above in this Privacy Policy, MWM provides you choice prior to sharing your personal information with third parties for their direct marketing purposes. If you do not opt-in or if you choose to opt-out at the time MWM offers that choice, MWM does not share your information with that identified third party for its direct marketing purposes.

Pursuant to Nevada law, consumers in Nevada have the right to opt-out of the sale of certain personally identifiable information we have collected about you through our Services.  Please note that MWM does not currently sell your covered information as those terms are defined under applicable Nevada law. However, you may still submit an opt-out of future sales and we will honor that request as required by Nevada law, if MWM were to engage in such a sale in the future. If you are a Nevada resident and would like to opt-out of future sales of your information, you must submit your request to legal@madisonwellsmedia.com. Your request must include “Nevada Opt-Out” in the subject line and the email should include your full name, street address, city, state, and zip code. Please contact us from the email address you have used to interact with us, or else provide us with that email address so that we can contact you if needed regarding this request. If you previously provided a phone number to us, including it will assist us in making sure we identify you as someone who wants to proactively opt-out and processing your request. We are not responsible for requests that do not come through the designated request mechanism or do not contain sufficient information to allow us to process your request. You may also be required to take reasonable steps as we determine from time to time in order to verify your identity and/or the authenticity of the request.
